In British Columbia, probate fees (also known as probate taxes) are officially called Probate Filing Fees. They are payable when applying for a Grant of Probate or Administration. These fees are governed by the Probate Fee Act, R.S.B.C. 1996, c. 370.

Probate fees are payable to the Minister of Finance and are separate from any legal or professional fees incurred during the probate process
When Probate Fees Apply
Probate fees apply to the value of the deceased’s estate (specifically the assets that require probate) at the date of death. This generally includes:
Real estate solely in the deceased’s name
Bank accounts solely in the deceased’s name
Investments (stocks, bonds, mutual funds, GICs) solely owned by deceased
Personal property (vehicles, valuables, etc.) solely in the deceased’s name
Assets typically excluded (do NOT attract probate fees):
Jointly owned property with right of survivorship (e.g., joint tenancy)
Assets with named beneficiaries (RRSPs, RRIFs, TFSAs, life insurance)
Assets held in trust Assets gifted or transferred prior to death
How Probate Fees Are Calculated
Probate fees in BC have two tiers:
Estate Value
Up to $25,000 - No Fee
$25,000.01 – $50,000 - $6 per $1,000 (0.6%)
Over $50,000 - $14 per $1,000 (1.4%)
Court Filing Fee:
A $200 flat fee is required when applying for a grant of probate or administration for estates valued over $25,000
Certified Copies:
Each certified copy of the grant of probate or statement of assets and liabilities costs $40
